- B2B Focus: PolarPoly primarily operates as a Business-to-Business (B2B) global sourcing and growth platform. By registering an account or placing an order, you represent and warrant that you are purchasing goods for commercial, business, or resale purposes, and you have the legal authority to bind your respective company.
- Age Requirement: You must be at least 18 years old to use this Site.
2. Product Descriptions and Orders
- Information Accuracy: We strive to provide accurate descriptions of plastics, home & lifestyle, beauty, and electronic products. However, we do not warrant that product descriptions, specifications, or other content are entirely accurate, complete, reliable, or error-free.
- Order Acceptance: Your order constitutes an offer to purchase. We reserve the right to accept or decline any order at our sole discretion. A contract of sale is only formed when we send you a formal shipping confirmation or order acceptance notification.
3. Pricing, Taxes, and Duties
- Prices: All prices are subject to change without notice.
- Import Duties and VAT: For international shipments (including but not limited to the USA, EU, and Middle East), the buyer is solely responsible for all applicable customs duties, import taxes, Value Added Tax (VAT), and clearance fees required by the destination country.
4. Shipping, Risk of Loss, and Incoterms
- Shipping: We partner with a global network to ensure our 99.8% on-time delivery rate. However, shipping dates are estimates and not guaranteed.
- Risk of Loss: Unless otherwise specified in a separate commercial agreement, all international shipments are governed by the specific Incoterm (e.g., FOB, CIF, DDP) agreed upon during the checkout or contract phase. If no Incoterm is specified, the risk of loss and title for items pass to you upon our delivery to the carrier.
5. Return and Refund Policy
Due to the nature of cross-border trade, returns are generally only accepted for defective or non-conforming products. You must inspect all goods immediately upon receipt and notify us in writing within seven (7) days of delivery regarding any defects. Authorized returns must follow our specific RMA (Return Merchandise Authorization) process.
6. Export Compliance and Sanctions (Global & Middle East Markets)
You agree to comply strictly with all applicable export control laws, regulations, and economic sanctions of your jurisdiction, the United States, the European Union, and the United Nations. You represent that you are not located in, under the control of, or a national or resident of any comprehensively sanctioned country or territory, nor are you listed on any restricted parties list.
7. Intellectual Property
All content on the Site, including but not limited to text, graphics, logos (such as the PolarPoly logo), icons, and images, is the property of PolarPoly or its content suppliers and is protected by international copyright and trademark laws.
8. DISCLAIMER OF WARRANTIES
THE SITE, SERVICES, AND ALL PRODUCTS PURCHASED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.
10. Force Majeure
PolarPoly shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, customs delays, or shortages of transportation facilities, fuel, energy, labor, or materials.
11. Dispute Resolution
- Arbitration & Class Action Waiver: Any dispute arising out of or relating to these Terms or the breach thereof shall be finally resolved by binding arbitration administered by the International Chamber of Commerce (ICC). You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
